1. INTRODUCTION & ACCEPTANCE OF TERMS
Welcome to CarCustomizer AI ("Application," "Service," "we," "us," or "our"). These Terms of Service (together with our Privacy Policy, our "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and the company operating CarCustomizer AI, regarding your access to and use of our mobile application available on iOS.
By downloading, installing, or using CarCustomizer AI in any manner, you acknowledge that you have read, understood, and agree to be bound by all terms, conditions, and notices contained in this Agreement. If you do not agree to these terms, you must immediately cease using the Application and uninstall it from your device.
2. ELIGIBILITY & ACCOUNT CREATION
2.1 Age Requirements
You represent and warrant that:
- You are at least 18 years old, or the age of legal majority in your jurisdiction
- If you are between 13-18 years old, you have obtained parental or guardian consent to use this Application
- You have the legal authority to enter into this Agreement
- You are not prohibited by law from using the Application
We reserve the right to verify age at any time and restrict access to users who do not meet our requirements.
2.2 Account Information
When creating an account, you agree to:
- Provide accurate, complete, and current information
- Maintain the confidentiality of your login credentials
- Notify us immediately of any unauthorized use of your account
- Accept full responsibility for all activities under your account
We are not responsible for any loss or damage arising from your failure to provide accurate information or protect your account credentials.
2.3 Account Suspension & Termination
We reserve the right to suspend or terminate your account, without notice or liability, if:
- You violate any terms of this Agreement
- You engage in fraudulent, abusive, or illegal activity
- Your account is inactive for more than 365 consecutive days
- We suspect unauthorized or unlawful use of the Service
3. LICENSE GRANT & INTELLECTUAL PROPERTY RIGHTS
3.1 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application solely for personal, non-commercial purposes, subject to compliance with this Agreement. This license does not permit you to:
- Modify, adapt, translate, or create derivative works
- Reverse engineer, decompile, or disassemble the Application
- Sell, rent, lease, or sublicense the Application
- Use the Application for any commercial purpose
- Remove, alter, or obscure any copyright, trademark, or proprietary notices
3.2 Intellectual Property Ownership
CarCustomizer AI, including all software, code, design, graphics, user interface, and content ("Content"), is the exclusive intellectual property of CarCustomizer and its licensors. All rights are reserved worldwide.
AI-Generated Transformations: We retain ownership of:
- The AI algorithms and models used to generate transformations
- The transformation technology and methodology
- Aggregated, anonymized usage data and patterns
However, you retain ownership of:
- Your original uploaded photographs
- Your non-AI-generated content
3.3 Your Content License Grant
By uploading photos or other content to CarCustomizer AI, you grant us a worldwide, royalty-free, non-exclusive license to:
- Process your content to generate AI-powered transformations
- Store your content as necessary to provide the Service
- Use anonymized data derived from your content to improve our AI models
- Display your content within the Application (with your consent)
You represent and warrant that you own or have obtained all necessary rights to grant this license.
4. ACCEPTABLE USE POLICY
4.1 Prohibited Conduct
You agree NOT to use the Application to:
Illegal Activities:
- Violate any local, state, national, or international law
- Facilitate fraud, money laundering, or other financial crimes
- Engage in any form of terrorism or extremism
Harmful Content:
- Upload, generate, or distribute sexually explicit, child exploitation, or CSAM content
- Create deepfakes intended to deceive, defame, or sexually humiliate
- Generate content that incites violence, hatred, or discrimination
- Create disinformation or deliberately misleading content designed to spread falsehoods
System Abuse:
- Attempt to hack, probe, or test the Application's security systems
- Introduce viruses, malware, spyware, or other harmful code
- Flood the system with excessive requests (DDoS attacks)
- Scrape, crawl, or extract data from the Application
- Attempt to gain unauthorized access to the Application's servers or databases
Commercial Misuse:
- Use the Application for commercial purposes without authorization
- Resell, rent, or distribute the Application or its transformations
- Use the Application's transformations for commercial advertising without permission
- Create competing applications using our technology
Harassment & Abuse:
- Harass, threaten, intimidate, or defame other users
- Impersonate others or misrepresent your identity
- Stalk, dox, or engage in cyberbullying
- Send unsolicited commercial messages or spam
4.2 Content Moderation & Enforcement
We reserve the right to:
- Immediately remove prohibited content
- Suspend or terminate accounts engaged in prohibited conduct
- Report suspected illegal activity to law enforcement
- Cooperate with legal authorities in investigations
- Take action without prior notice if content poses imminent harm
5. PAYMENT, CREDITS & SUBSCRIPTIONS
5.1 In-App Purchases
CarCustomizer AI offers:
- Credit Packs: One-time purchases (Starter: $9.99, Pro: $22.49, Elite: $39.99)
- Subscriptions: Recurring billing (Monthly: $9.99, Annual: $99.99)
5.2 Pricing & Billing
- All prices are displayed in USD and exclude applicable taxes
- Taxes will be added at checkout based on your billing location
- Pricing may change, with advance notice provided via the Application
- We reserve the right to refuse or cancel any transaction
5.3 Subscriptions & Auto-Renewal
By purchasing a subscription, you authorize recurring charges to your payment method:
Monthly Subscription ($9.99/month):
- Renews automatically each calendar month
- Your subscription continues until you cancel
Annual Subscription ($99.99/year):
- Renews automatically each calendar year
- Represents significant savings versus monthly pricing
Cancellation:
- You may cancel anytime through your Apple account settings or within the Application
- Cancellation takes effect at the end of your current billing period
- No refunds are issued for partial periods, except as required by law
- Immediately upon cancellation, you lose access to premium features
5.4 Refund Policy
Refunds for Subscriptions:
- Subscriptions may be cancelled anytime; the cancellation takes effect at the end of the current billing period
- If you cancel within 14 days of a new subscription or renewal, you may request a refund, subject to verification
Refunds for Credit Packs:
- Unused credit packs may be refundable within 14 days of purchase if credits have not been redeemed
- Credits used to generate transformations are non-refundable
App Store Refunds:
- All refund requests must be submitted through Apple's App Store
- We comply with Apple's refund policies and provide necessary information to Apple
5.5 Payment Method & Security
- Payments are processed through Apple's App Store
- We do not store your full payment card information
- You are responsible for maintaining the confidentiality of your Apple ID
- You acknowledge that charges are final and non-refundable except as outlined above
6. FREE CREDITS & LIMITED FEATURES
6.1 Free Generation Allowance
Registered users receive:
- 2 free AI-powered transformations per calendar month
- Transformations include watermarked images
- Watermarks are removed upon payment or subscription activation
6.2 Guest Mode Limitations
Guest users (without account) can:
- Browse the Application interface
- Upload photos and select modifications
- Preview modification selections
Guest users CANNOT:
- Generate AI transformations without creating an account
- Access their history or saved transformations
- Download or share results
7. USER-GENERATED CONTENT & PRIVACY
7.1 Your Responsibility
You are solely responsible for:
- All content you upload (photographs, data, personal information)
- Ensuring you own or have licensed all rights to your content
- Obtaining necessary consents from individuals whose likeness appears in your photos
7.2 Content Storage & Processing
By uploading content, you acknowledge that:
- Your content is temporarily stored on our servers to generate transformations
- Your content may be processed by third-party AI providers (disclosed in our Privacy Policy)
- We automatically delete your uploaded content after generating transformations (unless you save the result)
- Saved transformations are stored on our servers for your exclusive access
7.3 Sharing & Distribution
You agree that:
- You have full rights to download and share transformations you generate
- You will not claim ownership of our AI technology when sharing results
- You will not use transformations for commercial purposes without explicit authorization
- Transformations remain subject to the intellectual property restrictions in this Agreement
8. WARRANTY DISCLAIMERS
8.1 "As-Is" Service
CarCustomizer AI is provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, express or implied, including:
- Merchantability, fitness for a particular purpose, or non-infringement
- Title, quiet enjoyment, or uninterrupted access
- Accuracy, reliability, or completeness of transformations
- Freedom from defects, errors, viruses, or malware
We do not warrant that the Application will:
- Meet your specific expectations or requirements
- Be uninterrupted, error-free, or secure
- Be compatible with all devices or iOS versions
- Produce flawless or realistic transformations
8.2 AI Accuracy Disclaimer
Transformation Quality: AI-generated transformations are approximations and may not accurately represent actual physical modifications. CarCustomizer AI is a visualization tool; results should not be relied upon as professional design guidance.
Not Professional Advice: Transformations do not constitute professional automotive, design, or engineering advice. Before making actual modifications, consult with qualified professionals.
9. LIMITATION OF LIABILITY
9.1 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CarCustomizer AI AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any direct, indirect, incidental, special, consequential, or punitive damages
- Lost profits, revenue, data, goodwill, or business opportunities
- Costs of substitute goods or services
- Personal injury, property damage, or emotional distress
- Any damages arising from:
- Use or inability to use the Application
- Unauthorized access to your account
- Deletion, corruption, or loss of your data
- Third-party content or conduct
- Network outages or service interruptions
- Reliance on transformation accuracy or quality
This limitation applies even if we have been advised of the possibility of such damages.
9.2 Liability Cap
Except for indemnification obligations, in no event shall CarCustomizer AI's total liability to you exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.
10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless CarCustomizer AI and its affiliates, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to:
- Your violation of this Agreement
- Your use of the Application
- Your violation of applicable law
- Your content or conduct
- Your infringement of third-party intellectual property rights
- Claims by third parties arising from your use of transformations or shared content
11. THIRD-PARTY SERVICES & LINKS
The Application may contain links to third-party websites, services, or content ("Third-Party Services"). We:
- Do not endorse, control, or assume responsibility for Third-Party Services
- Are not liable for third-party content, privacy practices, or conduct
- Recommend reviewing third-party terms and privacy policies
Your use of Third-Party Services is governed by their terms and policies, not this Agreement.
12. CHANGES TO TERMS & SERVICE
We reserve the right to modify this Agreement at any time. Changes are effective immediately upon posting to the Application. Your continued use of the Application after changes constitutes acceptance of the modified terms.
We will notify you of material changes via:
- In-app notification
- Email to your registered account
- Update to the "Last Updated" date at the top of this document
13. DISPUTE RESOLUTION & GOVERNING LAW
13.1 Governing Law
This Agreement is governed by and construed in accordance with the laws of Wyoming, United States, without regard to its conflict of law principles.
13.2 Arbitration (US Users)
ANY DISPUTE ARISING FROM THIS AGREEMENT SHALL BE RESOLVED THROUGH BINDING ARBITRATION, except as exempted below:
- All claims will be arbitrated individually (no class actions)
- Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules & Procedures
- You and we may litigate in small claims court if the claim is within that court's jurisdiction
- Either party may seek injunctive relief in court to prevent infringement or misuse
13.3 Jurisdiction & Venue (International Users)
For users outside the United States, any legal action shall be brought in the courts of Delaware, and you irrevocably consent to the exclusive jurisdiction and venue of such courts.
14. ADDITIONAL PROVISIONS
14.1 Severability
If any provision of this Agreement is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
14.2 Entire Agreement
This Agreement (including our Privacy Policy) constitutes the entire agreement between you and CarCustomizer AI and supersedes all prior negotiations, discussions, and understandings related to the Application.
14.3 Waiver
No waiver of any provision of this Agreement is valid unless in writing and signed by both parties. Failure to enforce any right does not constitute a waiver of that right.
14.4 Survival
Sections 3 (Intellectual Property), 7 (User-Generated Content), 8-10 (Disclaimers & Liability), and 13-14 (Dispute Resolution & Additional Provisions) survive termination of your account or this Agreement.
